No imminent threat to exclusivity following French competition ruling, say experts.

The Times reports that O2's iPhone exclusivity deal in the UK is safe for the time being, despite the competition authorities in France calling time on a similar agreement between Orange and Apple.

The article says that while competition laws across the EU are harmonised, any ruling would have to be made based on local conditions, with the UK market being sufficiently different from France to make like-for-like comparisions with the Orange ruling unfeasible.

Mike Conradi, a partner with law firm Kemp Little, said: “There's no reason that just because they've reached that decision in France that the regulator or the courts would reach the same decision in the UK.”
