WIN and Bango among the first to come out in support of regulatory action
The UK mobile content industry appears to be getting behind the actions of regulator PhonePayPlus, which this morning unveiled measures to curb rising consumer complaints.
Simultaneously, the European Commission is also taking steps against websites across the continent it estimates are offering mobile content in breach of regulations.
Reacting to the news Sally Weatherall, commercial director at service provider WIN, welcomed the move but added that regulation needs to "bite at the point of consumption".
She said: "[Companies like WIN] must have a responsible and pro-active approach to regulating services. However, they are limited to regulating that element of the service over which they have control [i.e.billing]. The marketing and technical environments outside that control can only be reactively regulated through contractual enforcement. Clearly the rise in complaints and the EU consumer report released this week shows that this model is not as effective as it needs to be."
Meanwhile Ray Anderson, CEO of Bango, said: "There are a few rogue mobile content vendors who have been bringing down the reputation of the industry with bad practices that are blatantly designed to con the consumer. The UK mobile payments standard, Payforit, was created to catch these bad practices by making it much clearer what the consumer is paying for, with the option to cancel at any time. It's good news for all us in the mobile content business that these rogue vendors are finally being investigated and hopefully will either shut down or be forced to change the way they sell their services."

It's not just the content vendors. Distributors like mBlox need to clean their act up or be closed down. I've just had £40 PAYG credit wiped out, courtesy of mBox and services I never subscribed to. Even though I have been actively trying to get the money back for over a week, mBlox texted me today to say I had insufficient credit to pay for their latest attempted delivery of crap. What a joke!
They have been fined on an almost monthly basis for the past 2 years for breaking the rules and yet owner Andrew Bud is allowed to keep his place on the Phonepayplus board. Premium rate services should be on the same basis as Direct Debits and distance selling, and contracts need to be in writing. We need legislation to back up regulation and a willingness to impose punitive fines as well as prison sentences. It's the only way that opportunists like Bud will actually start to toe the line.
The industry isn't worried, they have no reason to be. When the same people work for the regulator and the companies involved you don't get regulation.
When there's enough money and enough people getting a share, there's little chance of anything changing.
