Vivid to HTC - stop infringing our trademark

Row erupts over the phone maker's new Vivid handset.

TMZ has reported that the porn distributor has sent a cease and desist letter to HTC America over the naming of its new smartphone.

It demands that HTV stops using the name "in association with the marketing and sale of a wireless device that your company advertises can surf online websites and is 'built to entertain, with movies and shows' on a 4.5-inch screen."

Hurt and upset, Vivid goes on to say that this "creates the false impression that your company and your company's products are affiliated, connected, or associated with and or sanctioned by Vivid Entertainment."

HTC America has until next Monday to respond or legal action will start.

It all seems a bit rich for the porn industry to get all protective. After all, this is the trade that makes films very closely based on Hollywood blockbusters such as Shaving Ryan's Privates and In Diana Jones.
